Your Data, Our Responsibility

This Privacy Policy explains how The Yours Truly Pvt Ltd  (hereinafter, “we”, “us”, or “FlexEm”) collects, uses, discloses, and secures information from or about you (hereinafter, “you” or “End User”). You can learn more about FlexEm’s Offering on the Website.
By accepting this Privacy Policy, or by accessing and/or using FlexEm’s Offering, you agree to be bound by its terms. If you do not agree to (or cannot comply with) all of the terms set out under this Privacy Policy, you may not access or use FlexEm’s Offering. If you represent another Person, you warrant that you have the authority, intention, and capacity to accept this Privacy Policy on behalf of such Person.
You authorize FlexEm and the applicable Client to act on your behalf to obtain, store, transmit, process, use, and disclose the information collected from or about you in accordance with this Privacy Policy.

Please read this Privacy Policy carefully:

1. End User Agreement

This Privacy Policy forms a part of the End User Agreement and must be read together with the End User Agreement. Any capitalized terms not expressly defined in this Privacy Policy have the meanings attributed to them in the End User Agreement.

2. Certain Defined Terms

  1. “Privacy Policy” means this document.
  2. “Minor” means an individual who is less than the minimum age prescribed under law to provide consent or to enter into contracts, provided that in no event will such age be less than 16 years.
  3. “Person” means any individual, partnership, limited liability partnership, limited liability company, body corporate, corporation, association, society, trust, or other entity or organization, whether or not a juridical person.

3. What Information We Collect

  1. Information Provided by You
    We may collect information when you access or avail of FlexEm’s Offering in any of the following ways:

    During Account Setup or Access:
    Identifiers and login information required for FlexEm’s Offering, such as your username, password, or security token.
    Your name, phone number, email address, physical address, one-time password (OTP), and any other details needed to verify your identity before connecting your Accounts.
    Any other information necessary to provide any part of FlexEm’s Offering, depending on the functionality and integrations you request.

    When You Communicate with Us:
    If you contact customer support, use the client application, or otherwise communicate with us, we may collect details such as your username, email address, date of birth, and phone number.

    With Your Permission:
    Where you provide specific authorization, we may collect or store any additional data you supply.
  2. Acquired Data
    With your authorization, we collect data from connected Platform(s). Depending on the Platform and the information requested by the relevant Client, this may include:

    Identity Information:
    Full name, gender, email addresses, phone number (and phone type), physical address, profile picture, profile biography, profile URL, date of birth, affiliations, documents, licenses, and government IDs.

    Network Information:
    Data about your connections (followers, subscribers, friends), including social media handles and demographic or analytical information about those connections, to the extent available or provided by the Platform.

    Device and Usage Data:
    IP address, service provider, device and browser details (operating system, hardware model), time zone settings, and device location.

    Client-Provided Information:
    Any information supplied by a Client (e.g., name, phone number, address, email address, ZIP code).

    Engagement Metrics:
    Data used to assess your reputation and engagement, such as follower count, view counts, save counts, likes and dislikes, content URLs, content types, timestamps, content captions or descriptions, impressions, comments, ratings, feedback, reviews, achievements, awards, and recognitions.

    Location and Location History:
    Tracked by the connected Platform(s).
  3. Cookies and Similar Technologies
    We use cookies and similar tracking technologies to collect information. See Clause 8 for details.
  4. Inferences
    We analyze collected or provided data and draw inferences about you. These inferences may be generated internally or by third parties.

4. How We Use Your Information

We use your data for various commercial and business purposes, including but not limited to:

  1. Operating the Offering:
    – To maintain, operate, and provide FlexEm’s Offering.
  2. Enhancements and Development:
    – To improve, modify, and develop FlexEm’s Offering and to create new services.
  3. Statistics and Analytics:
    – To generate anonymized statistics that are not attributable to you or any Person (for example, the number of users from a particular Platform in a specific region). These anonymized statistics may be published on our Website or in marketing materials.
  4. Usage Tracking and Analysis:
    – To analyze how you use FlexEm’s Offering and to enhance user experience.
  5. Support and Communication:
    – To provide customer support and communicate with you, Clients, or Platforms.
  6. Legal, Contractual, and Compliance:
    – To meet our contractual and legal obligations, defend against claims, and protect rights.
  7. Security and Fraud Prevention:
    – To investigate misuse, criminal activity, or unauthorized access or use of FlexEm’s Offering and/or infrastructure.
  8. Other Purposes with Consent:
    – For any other notified purposes with your explicit consent.

5. How We Share Your Information

We share your data for legitimate business purposes and as permitted or required by law:

  1. At Your Request:
    With a Platform when you explicitly authorize such sharing.
    With a third party when you explicitly request it.
  2. Legal and Regulatory:
    – With any authority (judicial, quasi-judicial, or executive) or any person (including professional advisors) as required to enforce legal or contractual rights or defend against claims.
  3. Service Providers and Partners:
    – With data processors, service providers, partners, or contractors who perform services on our behalf or on behalf of a Platform. This includes analytics providers, internal collaboration tools, user research and survey services, email services, CRM solutions, sales and marketing tools, event management, hosting, customer support, lead generation, document management, payment processing, cloud storage, data warehousing, fraud prevention, identity verification, and security services.
  4. Change in Ownership:
    – In connection with a merger, acquisition, sale of assets, or change in control of any part of our business.
  5. Affiliates:
    – Between and among FlexEm and our current and future parents, affiliates, subsidiaries, and other entities under common control or ownership.
  6. Professional Advisors:
    – With consultants and professional advisors who are legally or contractually required to maintain confidentiality.
  7. Protection of Rights and Safety:
    – When we believe reasonably appropriate to protect the rights, privacy, safety, or property of End Users, Clients, our partners, FlexEm, or others.
  8. With Your Consent:
    – With any other person or entity when you explicitly consent.
  9. Anonymized Data:
    – We may collect, use, and share anonymized data for any purpose, including research and development.

6. Platforms and Your Data

  1. Once you authorize FlexEm to share content with any Platform, FlexEm is no longer responsible for that shared content. Instead, the Platform controls that data and is subject to its own terms and policies. We encourage you to review the privacy policies of any Platform you choose to access or share data with via FlexEm’s Offering.
  2. FlexEm’s Offering may use APIs provided by certain Platforms. If you wish to revoke FlexEm’s access to data from a Platform you previously connected, you must follow the Platform’s instructions for revoking third-party access.

7. Data Security

We take commercially reasonable steps to protect your information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, no security system is impenetrable, and we disclaim responsibility to the extent that your data may be intercepted during transmission or stored on our databases. We cannot guarantee absolute security of your data.

8. Cookies

  1. What Are Cookies?
    – Cookies are small data files stored by your browser on your device’s hard drive or memory. They enable us to personalize your experience, maintain persistent sessions, collect demographic information, and monitor usage and advertising activities. Cookies typically contain information such as website preferences, user settings, and browsing history.
  2. Types of Cookies We Use:
    Session Cookies: – Used to make navigation of FlexEm’s Offering easier. These cookies terminate when you end your browser session.
  3. Types of Cookies We Use:
    Persistent Cookies:– Remain on your device for an extended period or until deleted. Persistent cookies can store login credentials so you don’t have to re-enter them on subsequent visits.
  4. Managing Cookies:
    – You may be able to disable cookies in your browser settings. The process varies by browser and device—please consult your browser’s documentation or customer support. If you choose to disable cookies, certain features of FlexEm’s Offering may not function properly or as intended.

9. Our Retention Practices

  1. We retain your personal data only as long as necessary to fulfill the purposes for which it was collected and used, unless a longer retention period is required or permitted by law.
  2. Anonymized data may be retained indefinitely.
  3. Your personal data may be retained if required by applicable law.
  4. You may request deletion of your personal data (other than anonymized data) at any time by contacting us as described in Clause 15, provided such deletion is legally permissible. We may require additional information to confirm your identity before processing a deletion request.
  5. If you terminate your account under the End User Agreement, we will delete all your personal data (other than anonymized data) and will no longer be able to provide you with our Offering.

10. Children’s Privacy

Our services, including FlexEm’s Offering, are not directed at minors (as defined above). We do not knowingly collect, maintain, or use personal information from minors without verified parental or guardian consent. If we learn that we have collected personal information from a minor without consent, we will promptly delete that information and terminate the minor’s access to FlexEm’s Offering. If you become aware that a minor has provided us with personal information without consent, please contact us (see Clause 15) so we can take prompt action.

11. Links to External Websites

FlexEm’s Offering may contain links to third-party websites. We have no control over their content, practices, or policies (including privacy). Accordingly, we disclaim responsibility for any third-party content, practices, or policies. You should review the privacy policy and terms of service of any third-party site before providing personal information or using their services.

12. Do Not Track

FlexEm does not maintain a “Do Not Track” mechanism. We are unable to respond to browser or device requests to disable tracking.

13. Effective Date and Changes to the Privacy Policy

This Privacy Policy is effective as of the date specified above. We may update this Privacy Policy from time to time. If we make material changes, we will notify you of such updates through FlexEm’s Offering or via email (if available). The effective date at the top of this Privacy Policy will reflect any changes. You are encouraged to review this Privacy Policy whenever you access FlexEm’s Offering or otherwise interact with us. Continued use of FlexEm’s Offering after any updates constitutes your consent to the revised Privacy Policy. We may be unable to continue providing FlexEm’s Offering to you if you do not accept the updated terms.

14. Third-Party Data Usage

This Privacy Policy does not describe how third parties (including Platforms and Clients) use your data. All third-party services, offerings, and processes are subject to that third party’s policies. FlexEm takes no responsibility for how any third party uses your data, whether they receive it through FlexEm or otherwise. If you wish to exercise rights against a Platform or Client, you must contact that Platform or Client directly; your rights with respect to them are governed by their respective policies.
